RTS attorneys have represented multiple governmental agencies over the years including the West Lafayette Community School Corporation, the City of West Lafayette, the White County Area Plan Commission, the White County Board of Zoning Appeals, and the Lafayette Police Merit Commission.  Since 1984, our firm has also had an attorney serve on the Tippecanoe County Election Board.

In addition to representing administrative agencies, our attorneys assist clients with issues before various governmental agencies including zoning boards, plan commissions, the Equal Employment Opportunity Commission, the Indiana Civil Rights Commission, and the Indiana Department of Workforce Development.


With several attorneys who possess a background in agriculture operations, RTS is uniquely positioned to assist clients with agriculture law issues involving not only plants and animals, but also land use, use of food products, and environmental regulations.  Our services include negotiating and drafting farm leases, providing counsel in the sale and financing of agricultural land, and succession planning for farm operations.  With an attorney actively engaged in farming we have first-hand knowledge and understanding of the legal challenges modern day farmers face.


RTS has represented numerous local, regional, and national financial institutions in commercial financing transactions by providing services ranging from the negotiation of title insurance and endorsements for loan policies, the preparation of loan documents such as loan agreements, promissory notes, mortgages, assignments, certificates, and surety documents, to litigation and/or dispute resolution counsel in real estate foreclosures, workout agreements, and deed-in-lieu transactions.  Our attorneys are also experienced in preventing and defending lender liability claims and enforcing security interests in various types of collateral.  We routinely counsel both borrowers and lenders on multi-million dollar complex financing transactions.


RTS is one of the few law firms in the country with experience representing clients with respect to bioenergy development issues.  We have advised and counseled clients regarding equity and financial arrangements for alternative fuel projects, assisted companies in safeguarding their discoveries and brands, facilitated the negotiation of contracts with contractors, developers, suppliers, customers and other business partners, apprised clients of the latest environmental regulations, and helped our clients navigate interaction with federal and state governmental agencies. In the event a dispute arises, RTS also has the experience and resources necessary to prosecute and/or defend our clients’ interests.


RTS has represented clients in civil appeals before the Indiana Court of Appeals involving matters ranging from the enforcement of a city occupancy ordinance, restrictive covenants in an employment contract, and fraud and constructive fraud claims relating to the sale of a residence.  RTS also represented the West Lafayette Community School Corporation in Batagiannis v. West Lafayette Community School Corporation, a case involving due process and retaliation claims filed by the school corporation’s former superintendent and ultimately decided by the United States Seventh Circuit Court of Appeals.


RTS has developed a sizeable commercial litigation portfolio comprised of cases that the firm has handled for individual and corporate clients in both state and federal court.  RTS attorneys are experienced in both prosecuting and defending clients in a broad range of practice areas including complex real estate disputes involving multiple liens, receiverships, attachments, construction issues, and failed or troubled business relationships.  We have successfully prosecuted cases against Fortune 500 companies and have served as plaintiff’s counsel in nationwide class action cases.


RTS represents individuals and entities in construction matters involving cost overruns, site conditions, changes to scope of work, construction defects, defects in plans and specifications, delay, labor disruption and inefficiency, and termination of contractual relationships. RTS has experience representing clients in arbitrations, mediations, and trials at the state and federal level in both prosecuting and defending such actions.  RTS attorneys also provide construction contract drafting and review services. RTS has also represented clients in multi-faceted lien disputes involving commercial and residential real estate.


RTS attorneys are dedicated to providing knowledgeable and efficient representation to individuals and entities in matters of corporate organization and formation, real and personal property transactions, employee concerns and termination, contracting drafting and review, and conflict resolution through means of mediation, arbitration, or trial at the state and federal levels.  We have significant experience preparing and filing organizational documents for limited liability companies, for-profit corporations, and not-for-profit corporations.  Our attorneys routinely represent companies and individuals in the purchase and sale of their businesses. Over the years, RTS has been involved in hundreds of such transactions, ranging from the sale of the small mom and pop company to multi-million dollar acquisitions of businesses in multiple states.   We have also been involved in numerous complex merger transactions including multi-national reverse triangular mergers. Additionally, RTS has significant experience assisting clients in obtaining non-traditional financing and completing complex refinancing transactions.


Throughout the years, RTS attorneys have successfully litigated commercial and residential foreclosure proceedings for financial institutions, and have diligently and effectively represented individual and corporate creditors alike in all aspects of debt enforcement and recovery. 

RTS also represents creditors in bankruptcy proceedings by providing services that include preparing and filing of reaffirmation agreements and proofs of claim, attending 341 meetings of creditors; prosecuting and defending preference actions; litigating plan objections and claims disputes; and representing both plaintiffs and defendants in adversary proceedings.  We have also served as counsel for numerous chapter 11 creditor’s committees.

In addition to these services, RTS effectively handles and manages a wide variety of collection files including real estate, medical, and goods/services sold.  Our collection practice includes representing landlords in resolving tenant disputes through eviction or otherwise, collecting debts through payment arrangements or by obtaining a judgment against the delinquent party, overseeing post-judgment procedures, and maintaining detailed client accounts receivable/payment records and collection status.


RTS provides counsel to school corporation clients on matters involving collective bargaining, statutory construction, employee relations, bonds, construction contracts, and building and corporation policies.  Our attorneys have also represented school corporations as special counsel in instances involving disputes with sitting superintendents.  RTS attorneys are members of the Indiana Council of School Attorneys and have served as presenters at the annual Indiana School Board Association meeting in Indianapolis.


RTS has represented employer-clients in litigation in state and federal court and with respect to discrimination claims filed with the Equal Opportunity Commission and the Indiana Civil Rights Commission. In addition to these legal services, our attorneys also counsel employer-clients on matters involving employee benefits, discipline and termination, including drafting personnel policies and preparing and analyzing employment contracts.


Our comprehensive estate planning and probate practice is focused on providing support to clients of all backgrounds in the preparation of wills, powers of attorney, healthcare representative appointments, living wills, and trust agreements, both revocable and irrevocable, representation in probate proceedings, and advising clients on tax strategies and implications relating to estate planning and charitable giving.  We are uniquely qualified to provide our clients with estate planning strategies which will accomplish their goals of preserving and transferring wealth.  RTS attorneys are also experienced in handling contested and uncontested guardianship matters from inception through administration and subsequent termination of the guardianship.


RTS provides counsel to owners, developers, and lenders in commercial and residential real estate zoning and development.  Our firm advises a wide variety of clients ranging from individuals to Fortune 500 companies, with respect to rezonings, variances from zoning ordinances, development agreements, site plans, preliminary plats, final plats, text and ordinance amendments, ordinance interpretation, and all other aspects of the zoning and land use legislative and administrative processes.   We have assisted clients in successfully obtaining approvals for commercial and residential subdivision developments, special exceptions for mining operations, and developments for hotels and mixed use student-housing/retail complexes.


Mediation is a process whereby the parties to a conflict participate in a meeting facilitated by a neutral mediator whose role is to assist the parties in trying to reach a resolution of their dispute.

RTS provides mediation services regarding civil dispute matters, both before and after a lawsuit is filed.  Attorneys Jim Schrier and Kevin Riley are both registered mediators in the state of Indiana.  Jim Schrier has over 24 years of practice experience representing plaintiffs and defendants in hundreds of civil lawsuits.  Jim has worked as a registered mediator since 1999.  The primary focus of Jim’s mediation work is real estate claims, family disputes, personal injury, property damage disputes and business, construction and commercial litigation disputes.  Kevin recently completed the ICLEF 40 hour civil mediation training.  Kevin has represented clients in mediation involving real estate, contract, employment, trust, and estate issues.


RTS’s real estate practice involves both residential and commercial transactions throughout Indiana and includes representation of a broad range of clients, including real estate developers, individuals, lending institutions, as well as corporate clients. Our experience includes planning, structuring, preparing and reviewing legal and title documents, deeds, construction loan documents, purchase and sale agreements, leases, and construction management agreements.  RTS also litigates disputes that arise from both residential and commercial transactions including landlord representation in eviction proceedings and lender representation in mortgage foreclosure actions.


RTS attorneys represent a wide range of individual and corporate clients in matters of tax planning, tax compliance, and tax controversies.  Our tax planning services include providing tax planning advice relating to estate planning, business formation and organization, and the sale of real estate and/or businesses.  As part of our tax compliance services, we prepare and file tax returns for trusts, estates, individuals, and entities.  We are also experienced in representing clients in tax disputes, controversies, audits, and appeals involving the Internal Revenue Service and the Indiana Department of Revenue.


RTS helps companies successfully manage, maximize, and secure the value of their trademarks and the goodwill and brand names they represent across a wide variety of industry verticals.  RTS provides a full suite of trademark and brand management legal services to our client companies.  Such services include assisting our clients with the selection and availability of marks, filing and prosecuting applications in an effort to obtain federal and/or state registration(s), preparing and negotiating licenses and/or co-existence agreements, representing clients in appellate and adversary proceedings with the Trademark Trial and Appeals Board, and providing advice on the proper use of trademarks in advertisements, labeling, and packaging.
